Part 1 — Audio Engineering Services
1. Booking Confirmation
All bookings must be confirmed in writing (email is sufficient). A confirmed booking constitutes acceptance of these Terms & Conditions.
2. Standard Rates
Unless otherwise negotiated and confirmed in writing, the following rates apply:
- Day Rate (Show or Working Day): $700
- Travel Days: Charged at the full day rate of $700
- Per Diem: $80 per day, applicable to all show and travel days
- Off Days: Charged at 50% of the day rate ($350) if the engineer cannot be flown home
All rates are exclusive of GST.
3. Payment Terms
Payment terms will be outlined in the invoice. Unless otherwise agreed, full payment is due within 7 days of the final service date.
At the engineer's discretion, a late fee of 30% of the total invoice may be applied for every 7-day period the invoice remains unpaid beyond the due date.
4. Cancellation Policy
If the client cancels a confirmed booking:
- Within 14 days of the scheduled start: 50% of the agreed fee is payable
- Within 72 hours (3 days) of the scheduled start: 100% of the agreed fee is payable
These fees cover preparation time and lost opportunity. Exceptions may be made at the discretion of the engineer.
5. Travel & Accommodation
All travel arrangements (flights, transport, accommodation) must be approved by the engineer in advance. Reasonable quality accommodation and travel standards are expected unless otherwise agreed.
6. Technical Requirements
The client is responsible for providing all necessary technical specifications, schedules, and access to equipment in a timely manner. Any failure to do so may impact service delivery and does not exempt payment.
7. Liability
The engineer shall not be held liable for any issues arising from client- or third party-provided equipment or logistics.
8. Intellectual Property
Unless otherwise agreed, the client retains full rights to all recorded materials. The engineer may reference the project for promotional purposes (e.g., portfolio, website, social media).
9. Force Majeure
The engineer is not liable for failure to perform services due to circumstances beyond reasonable control, including but not limited to illness, technical failure, or acts of nature.
Part 2 — Sound Equipment Hire (Including Dry Hire)
This section applies to any hire of audio equipment and is in addition to the terms outlined in Part 1.
1. Definitions
- Dry Hire refers to equipment rental without an operator/engineer.
- Wet Hire refers to equipment rental with an engineer/operator provided.
- The Hirer refers to the individual or entity renting the equipment.
2. Booking & Confirmation
All hires must be confirmed in writing. A confirmed hire constitutes acceptance of these Terms & Conditions. Full details of hire duration, pickup/return times, and intended use must be provided prior to confirmation.
3. Hire Period
The hire period begins when equipment leaves the custody of the owner and ends upon return in acceptable condition. Late returns may incur additional fees.
4. Equipment Care & Responsibility
- The hirer is responsible for all equipment during the hire period, including during transport, setup, use, and storage.
- Equipment must be returned in the same condition it was supplied.
- Any loss or damage (including cosmetic, functional, or through misuse) is the full responsibility of the hirer.
- The hirer is responsible for securing appropriate insurance for the gear during the hire period.
5. Faults & Technical Support
All equipment is tested before dispatch. The hirer must report any faults immediately. No refunds will be provided for issues not reported during the hire period. Technical support is not included with dry hire unless otherwise arranged.
6. Return & Inspection
Equipment must be returned at the agreed time. Late returns may incur additional charges. All gear will be inspected upon return and the hirer will be invoiced for any damage, missing components, or cleaning required.
7. Sub-Hiring & Modification
The hirer must not sub-hire, lend, or modify any equipment without prior written permission.
